General and Specific Terms and Conditions of Sale for the General Public

Beaucaire Terre d’Argence Tourist Office and its Commercial Platform

“TERRE D’ARGENCE RESERVATION”

Any booking of services and products with the Beaucaire Terre d’Argence Tourist Office implies full acceptance of these Terms and Conditions of Sale, which shall prevail over any other general or specific terms.

The Beaucaire Terre d’Argence Tourist Office, registered under SIRET number 24300058500170 and intra-community VAT number FR ZN 243 000 585, with registered office at 1, avenue de la Croix Blanche, 30300 Beaucaire, represented by its President Juan-Antonio MARTINEZ, is registered in the Register of Travel and Holiday Operators under number IM030170007.

Financial guarantee: GROUPAMA Assurances Crédit & Caution, 8–10 rue d’Astorg, 75008 Paris.
Professional Civil Liability Insurance: AREAS DOMMAGES, 47–49 rue de Miromesnil, 75008 Paris, policy no. 0R206418, covering bodily injury, material and immaterial damage.


1 – GENERAL PROVISIONS

These general booking conditions are governed by the French law on the development and modernisation of tourism services of 22 July 2009.


2 – FORMATION OF THE CONTRACT

Any order for one or more services or products offered by the Beaucaire Terre d’Argence Tourist Office implies the client’s unconditional acceptance of these Terms and Conditions of Sale, which are available on the order form and on the websites www.terredargencetourisme.com and www.provence-camargue.tourisme.com.

The Tourist Office sells, via its website and its commercial platform “TERRE D’ARGENCE RESERVATION”, at the counter or by telephone, various services intended for private individuals, which are governed by these Terms and Conditions.

Orders may only be placed by users who have read and accepted these conditions in full. Without such acceptance, continuation of the ordering process is technically impossible. The user must be at least 18 years old, legally capable of entering into contracts, and must use the website in accordance with these Terms.

Except in cases of fraud, which the client must prove, the client is financially responsible for all actions taken on the website, including use of their username and password. The client guarantees the accuracy and truthfulness of the information provided.

Any fraudulent or suspected fraudulent use of the website, or any breach of these Terms, may result in denial of access to services or website functionalities at any time.


3 – LIABILITY

The Beaucaire Terre d’Argence Tourist Office is the sole point of contact for the client and is responsible for the proper performance of obligations arising from these Terms.

The Tourist Office cannot be held liable for total or partial non-performance of booked services or products due to unforeseeable events, force majeure, improper performance or fault on the part of the client, or actions by a third party unrelated to the organisation of the service.

Programmes depend on the opening days and hours of service providers. In the event of unexpected closure, the Tourist Office cannot be held liable for the non-fulfilment of a programme not caused by its own actions.


4 – BOOKING / PURCHASE

These Terms apply to all bookings and purchases made via the Beaucaire Terre d’Argence Tourist Office’s commercial platform “TERRE D’ARGENCE RESERVATION”:

A purchase becomes final upon confirmation by electronic or written booking or order number, sent no later than before the start of the service.

Online payment constitutes signature of the contract and acceptance of these General Terms and Conditions.

Booking confirmation, including essential details and price, will be sent by email within one business day, subject to availability.

TERRE D’ARGENCE RESERVATION reserves the right to correct pricing errors and may offer the client the choice to accept the corrected price, an alternative, or cancellation without penalty. Descriptions and photos are non-contractual.

Failure to pay deposits or full amounts by the specified deadline will result in automatic cancellation.

Specific payment terms apply for accommodation bookings, including balance payment deadlines, issuance of vouchers, security deposits for rentals, and non-tolerance of late payments.

Reminder: pursuant to Article L221-28 (12°) of the French Consumer Code, the 14-day withdrawal right does not apply to accommodation, transport, catering or leisure services provided on a specific date.


5 – NO RIGHT OF WITHDRAWAL

In accordance with French consumer law, no right of withdrawal applies to tourism services such as accommodation or activities. No refund will be granted once booked.


6 – PRICING

Unless otherwise stated, prices are in euros, VAT included. Local taxes (e.g. tourist tax) are payable on site and borne by the client. Prices may be modified at any time by the Tourist Office or providers.

For guesthouses, prices include accommodation with breakfast. Additional services must be paid on site.


7 – PERFORMANCE OF SERVICES AND/OR PURCHASES

The confirmation email serves as invoice and voucher and must be presented upon arrival or collection.

Service durations are fixed and cannot be extended. Punctuality is mandatory. Any delay or non-attendance will not result in a refund.

Specific provisions apply to:

  • accommodation stays

  • tourist activities and packages

  • click & collect product purchases

Examples of force majeure include natural disasters, extreme weather, strikes, serious health issues affecting providers, and administrative restrictions.


8 – PAYMENT TERMS

Payment conditions vary depending on the type of service (hotels, activities, packages, products) and booking lead time, with deposits or full payment required accordingly.


9 – UNAVAILABILITY

In case of accommodation unavailability, equivalent or superior alternatives will be offered at no extra cost.

For activities or products, rescheduling or refunds without penalty may be proposed. No compensation may be claimed.


10 – MODIFICATION OF BOOKINGS / PURCHASES

Any modification request must be notified by phone, email, or registered mail. Acceptance is not guaranteed and cancellation terms remain applicable.


11 – CANCELLATION BY THE CLIENT

Detailed cancellation penalties apply depending on service type and timing prior to arrival, including no-shows and early departure, with no refunds unless expressly stated.

Specific provisions apply for:

  • hotels

  • other accommodation and packages

  • activities

  • online shop purchases (click & collect), including withdrawal rights before collection only, exclusions for perishable goods, and defective products.


12 – CANCELLATION BY THE TOURIST OFFICE

If the Tourist Office cancels a service before it begins, the client will be informed in writing and fully refunded without penalty.


13 – INTERRUPTION OF SERVICE

No refund will be granted for services interrupted by the client.


14 – MINIMUM NUMBER OF PARTICIPANTS

Some services require a minimum number of participants. If unmet, alternatives or full refunds will be offered.


15 – INSURANCE

No insurance (cancellation, assistance, repatriation) is included unless expressly stated.


16 – RESPONSIBILITIES AND GUARANTEES

The Beaucaire Terre d’Argence Tourist Office acts as an intermediary and cannot be held liable for service provider failures, quality, or solvency.


17 – PHOTOGRAPHS

All photos and descriptions are for information purposes only and are non-contractual.


18 – INTELLECTUAL PROPERTY

Any reproduction of the websites or their content is strictly prohibited.


19 – PERSONAL DATA

Personal data is processed in compliance with GDPR and French law. Clients have rights of access, rectification, and deletion. Data is secured via certified payment systems.


20 – LINKS

The Tourist Office is not responsible for third-party website content accessed via links.


21 – DISPUTES / COMPLAINTS

Complaints must be submitted in writing within three days. Disputes fall under French law and the jurisdiction of the Administrative Court of Nîmes.


22 – MISCELLANEOUS

Failure to enforce any provision does not constitute waiver. Invalid clauses do not affect the validity of others.

The Tourist Office reserves the right to modify these Terms at any time.
